Licensed Producers in Canada

There are two ways to legally source medical marijuana in Canada:

Obtain a Growers License

Individuals who have been given permission by Health Canada may produce cannabis for their own medicinal use.  Seeds must be sourced from a producer who is authorized to grow and sell medical marijuana in Canada.

Licensed Producers

Licensed producers are weed growing companies who have applied to Health Canada and have been cleared to produce and distribute medical marijuana within the ACMPR guidelines.  Each applicant is screened, must pass all security clearances and is thoroughly reviewed.  All licensed producers must notify the municipal government, the local authorities and  the local fire department prior to submitting an application.

Access to Cannabis for Medical Purposes Regulations

The Access to Cannabis for Medical Purposes Regulations (ACPMR) came to be in August, 2016, as a result of the Federal Court of Canada’s decision in Allard v. Canada. In February, 2016, it was found that the requisite for Canadians using medical marijuana to source the product exclusively from licensed producers violated liberty and security rights of the individual, protected by section 7 of the Canadian Charter of Rights and Freedoms. It was deemed by the Court that individuals were not being given “reasonable access”, and that immediate resolution was required.

The ACMPR replaces the previous Canadian marijuana industry regulatory framework; Marihuana for Medical Purposes Regulations (MMPR) and now allows Canadians to apply to Health Canada to produce limited amounts of marijuana for their own medicinal use in addition to sourcing cannabis from licensed marijuana producers in Canada (licensed producers).
